Terms and Conditions / AGB
1. Scope
These Terms and Conditions apply to all purchases made by consumers through the online shop of Systemic Error.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
We currently sell only to consumers with a delivery address within the European Union.
The contract language is English. German translations may be provided for convenience. In case of discrepancies between the English and German versions, the English version prevails.
2. Contracting Party
The purchase contract is concluded with:
Systemic Error
Kaveh Najafian Razavi
Pulverteich 27
20099 Hamburg
Germany
Email: support@systemicerror.com
The online shop is operated by Kaveh Najafian Razavi under the trading name Systemic Error.
3. Conclusion of Contract
The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order.
Orders can be placed only through the checkout process of our online shop.
Before placing your order, you can review and correct the products in your shopping cart and the information entered during checkout.
By clicking the "Order with obligation to pay" button at the check out, you submit a binding order for the products shown in your shopping cart.
We acknowledge receipt of your order automatically. This acknowledgment does not yet constitute acceptance. The contract is concluded when we send a separate order-acceptance or dispatch confirmation, or when we dispatch the goods, whichever occurs first. Any earlier payment authorization or charge will be released or refunded if we do not accept the order.
The Terms and Conditions and withdrawal information applicable to your order are provided during checkout and are also sent to you by email or as attachments.
We store the order information required to process your order. If you create a customer account, you can view your order history in your account area.
If an order cannot be fulfilled after payment has already been made, for example because a product is unavailable or an obvious error has occurred, we will inform you without undue delay and refund the payment without undue delay. Your statutory rights remain unaffected.
4. Right of Withdrawal
Consumers have a statutory 14-day right of withdrawal for products purchased through our online shop, unless an exclusion applies.
Detailed information on how to exercise your right of withdrawal, including our withdrawal instructions and withdrawal form, can be found on our Withdraw from Contract page.
You may exercise your right of withdrawal by sending us a clear statement by email to support@systemicerror.com or by using the electronic withdrawal function provided on our website.
The right of withdrawal does not apply to products made to your individual specifications or products that are clearly personalized. Any such exclusion will be clearly indicated on the relevant product page before purchase.
We voluntarily extend the return period to 30 days from the day you receive the goods. This extension includes the statutory 14-day withdrawal period and does not limit your statutory rights.
The terms, conditions, and return logistics of this voluntary extension are explained on our Shipping & Returns page.
5. Prices and Shipping Costs
All prices include the applicable statutory value-added tax.
Prices are stated in Euros (€). The online shop may also display prices in other currencies for convenience.
Shipping costs are not included unless expressly stated otherwise. Any applicable shipping costs are shown during checkout before you place your order.
If payment is made in a currency other than Euros, exchange rates and any fees may be determined by the payment provider or the customer’s bank.
Further information about shipping costs can be found on our Shipping & Returns page.
6. Delivery
We ship only to delivery addresses within the European Union.
For made-to-order products, the production time is stated on the individual product page. Estimated shipping times begin once the item has been dispatched.
If your order contains different product types, they may arrive in separate parcels. For example, a studio-made object and a print-on-demand item fulfilled by a partner may be shipped separately.
You are responsible for providing a complete, accurate, and valid delivery address. If a package is returned to us because the address provided by you was incorrect or incomplete, we may charge you the direct cost of re-shipping the order.
Further information about delivery problems, return logistics, and voluntary returns can be found on our Shipping & Returns page.
Your statutory rights remain unaffected.
7. Payment
The available payment methods are shown during checkout and may vary depending on country, device, payment provider availability, and checkout settings.
Payment is due when you place your order.
For immediate payment methods, payment is processed during checkout by the respective payment provider.
8. Retention of Title
The delivered goods remain our property until full payment has been received.
9. Warranty and Liability
The statutory rights for defects under German law apply to all purchases.
Some products are made using digital fabrication, 3D printing, hand-finishing, craft-based production, or print-on-demand processes. Minor differences between product images and the delivered item may occur, including slight differences in color, brightness, contrast, material appearance, surface texture, print placement, scale, alignment, visible layer lines, small structural marks, or other production-related characteristics.
Such characteristics do not constitute a defect, provided that they do not impair the agreed quality, function, safety, or usual use of the product.
If an item arrives damaged, defective, or incorrect, please contact us at support@systemicerror.com so that we can review the issue and arrange an appropriate solution.
Depending on the situation and your statutory rights, this may include repair, replacement, refund, or another legally appropriate remedy.
Nothing in these Terms and Conditions limits your statutory warranty rights.
We are liable without limitation for damages caused intentionally or by gross negligence.
We are also liable without limitation for injury to life, body, or health, for claims under the German Product Liability Act, for guarantees expressly given by us, and in cases of fraudulently concealed defects.
In cases of slight negligence, we are liable only for the breach of essential contractual obligations. Essential contractual obligations are obligations whose fulfilment makes the proper performance of the contract possible and on whose compliance the customer may regularly rely.
In such cases, our liability is limited to the foreseeable damage typical for this type of contract.
Any further liability is excluded to the extent permitted by law.
The above liability rules also apply to our legal representatives and vicarious agents.
10. Consumer Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
